No-Poach Agreements: Consequences for Managers

Deals made between competitors not to hire or pursue each other’s employees, whether a verbal or written agreement, are illegal. In the past, the Department of Justice (DOJ) pursued civil penalties against companies that made these agreements, but recently, criminal charges have been brought by the department.

Compliance of competition laws falls mostly on managers. Agreements which seem courteous among competitors lead to hiring decisions that have formed the basis of no-poach litigation. The DOJ and the Federal Trade Commission (FTC) have issued guidelines on how to avoid no-poach violations.
